Essentially, the tort of negligence involves a person’s failure to take adequate care for something for which they are responsible. Negligence is a person’s failure to exercise the requisite standard of care which a reasonably prudent person would have been able to exercise if they were to find themselves in a similar situation. The entry point for this discussion into the second part is the question of what constitutes the tort of negligence. The third part of the paper shall then serve to conclude the essay. Further, it would explain how the development of the law of negligence has ensured that the element of the duty of care treats both the claimant and defendant fairly. The second part shall explore tort of negligence generally, and then its element of duty of care specifically. This first part is an introduction which also lays down the paper’s general outline.
